But be aware: if you are not a Dominican resident or citizen, and your stay exceeds 30 days in the country, you will need to pay an overstay tax upon departure. This requirement is imposed by the General Directorate of Immigration, in accordance with Law 285-04 on Migration.

Who is affected by this overstay tax?

This tax applies to anyone who does not have Dominican nationality and does not hold a temporary or permanent residence permit. If you enter the country with a tourist visa or under the visa exemption program, you are automatically granted a 30-day authorized stay. After that period, and as long as you do not apply for residency, your stay is still tolerated, but generates exit fees when leaving the country.

Should you worry if you’ve exceeded the legal stay?

Don’t worry – it is not a criminal offense. There is no additional fine, no ban on re-entry, and no criminal penalty. The Dominican Republic simply wants to regulate extended stays, not punish travelers.

You will just need to pay the tax corresponding to the length of your overstay when leaving the country (via the airport or seaport). This system is flexible and widely appreciated by long-term travelers who don’t wish to go through the residency process.

However, this tolerance does not replace official residency status. If you plan to live long-term, open a bank account, or purchase property, it’s better to apply for a temporary or permanent residence permit.

The tax helps regulate extended stays without official procedures, while offering a legal alternative for tourists who wish to stay longer than 30 days. It also assists the government in monitoring migration flows and funding tourism infrastructure.

Can the overstay tax be avoided?

The only way to avoid the tax is to leave the country before 30 days or to obtain resident status.
Upon leaving and re-entering, a new 30-day stay begins, but if done too often, authorities may suspect a hidden, undeclared residence.
